People often ask our firm if they can file for Social Security disability benefits if they are diagnosed with lung cancer. The Social Security Administration offers a list of requirements for one to be considered disabled. It essentially says that your condition has to prevent you from working a full-time job and that it’s expected to last for at least a year or result in death. These guidelines are the same for both Social Security Disability Insurance (SSDI) benefits and Supplemental Security Income (SSI) benefits.
For many Lung Cancer diagnoses, Social Security will fast-track your application and approval for benefits. The SSA’s computer system will flag an application to be expedited if it detects these diagnoses and scenarios:
- Non-small cell lung cancer that is either inoperable, unresectable (lung cancer that cannot be completely removed from surgery), recurrent, or has spread (“metastasized”) to or past the hilar lymph nodes (located where lymphatic vessels, arteries, and veins enter the lungs). The three types of Non-Small Cell Lung Cancer are Squamous Cell Carcinoma, Large Cell Carcinoma, and Adenocarcinoma. Adenocarcinoma has a subdivision of bronchioalveolar carcinoma, which is also known as lepidic adenocarcinoma.
- Small cell lung cancer.
- Sarcomatoid Carcinoma of the Lung – Stages II-IV, also known as Lung Carcinosarcoma; Pulmonary Sarcomatoid Carcinoma; Pulmonary Carcinosarcoma; Spindle-cell Carcinoma; Lung Sarcomatoid Carcinoma Stages II – IV
- Carcinoma of the superior sulcus (located at the top of the lungs) that has undergone multimodal anticancer therapy. Includes Pancoast tumors.
